So that all of our clients enjoy the best hosting service, we have the following terms of use. These are intended as guidelines and if you are unsure about any aspect of it, please contact us for clarification. By using our hosting services, you agree to comply with our terms of use, display common courtesy to other internet users and stay within UK law.
1. Abuse & Prohibited Use:-
1.1 AI Hosts’ service can only be used for lawful purposes. Using the service to store or distribute illegal data is strictly prohibited. AI Hosts reserves the right to decide as to what constitutes as abuse.
1.2 The list of prohibited data includes, but is not limited to -
(a) IRC Bots / Software
(b) BitTorrent software
(c) Proxy software
(d) Any Automated Bots
(e) Warez Sites and Indexing / Linking to other warez sites
1.3 Any attempts to compromise or actual compromise of a network device belonging to AI Hosts or any other company, individual, or other entity is strictly prohibited. This offence also includes port scanning, IP range scanners and vulnerability scanning. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.
1.4 Denial of Service (DOS) attacks directed at AI Hosts, or any attempts to launch a Denial of Service attack from our servers are strictly prohibited. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.
1.5 Hosting any software, source code or any other material that is illegal or could be used to commit an illegal act is strictly prohibited. This includes but is not limited to software exploits; exploiting source code, hacking tutorials, hacking tools, phishing, viruses and Trojans, bomb making and similar device tutorials. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.
1.6 The hosting of material that infringes on any copyright, trademark and or service mark is strictly prohibited. This also includes the storage and transmission of pirated movies, music, software, ring tones or anything else considered “Warez”. Any authentic complaint received will be investigated and may result in termination of service.
1.7 The hosting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.
2. Zero Tolerance Spam Policy:-
2.1 If you send unsolicited email messages, commonly known as SPAM, your account WILL be terminated, NO exceptions. The gathering of email addresses to be used for sending unsolicited email on a 3rd party service “harvesting” is also prohibited and may result in termination of service.
2.2 We have set a limit of 100 outgoing emails per hour on each account
2.3 Spamming activities also include (but not limited to) commercial advertising and informational announcements. A user shall not use another site’s mail server to relay mail without the express permission of the site or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial E-mail or spam.
3. Resource Usage:-
3.1 Abuse of resources include, but is not limited to:-
3.1.1 Usage 25% or more of system resources for longer then 90 seconds. These include, but are not limited to: CGI scripts, FTP, PHP, and HTTP.
3.1.2 Run any interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
3.1.3 Run stand-alone, unattended server-side processes at any point in time on the server. This includes, but is not limited to, IRCD, BotProcesses.
3.1.4 Run any software that interfaces with an IRC (Internet Relay Chat) network.
3.1.5 Run any gaming server instances.
3.1.6 Repeated infringements on account of excessive server-resource consumption may result in suspension OR termination of services.
3.2 Each mail box is limited to 500 MB in size.
4. Bandwidth Usage:-
Bandwidth is defined as the amount of traffic that is allowed to occur between your website & the rest of the internet. All bandwidth quotas are on a monthly basis. AI Hosts reserves the right to suspend services for an account which has exceeded the bandwidth quota allotted. Services would be restored on the start of the next cycle or upgrading of the bandwidth allowance, whichever is earlier. Carrying over of unused amount of bandwidth is not possible.
5. Payments, Verification & Account Setup:-
5.1 AI Hosts will not activate any service(s) until the client has paid in full.
5.2 Until and unless you notify AI Hosts of your desire to cancel any or all services received, those services will be billed on a recurring basis. Clients have to make appropriate payment for the services received from AI Hosts, before the payment due date during the duration of the services received.
5.3 AI Hosts reserves the right to change the monthly or annual payment amount and any other charges at anytime.
5.4 Clients will be invoiced before a renewal is due. Reminders will be sent a week before the renewal and again on the day of the renewal. A 4 day grace period will be allowed before the account will be suspended. A further email reminder will be sent on this day, and a further week will be allowed before the account is terminated. No backups will be provided in the event of an account being terminated. No access to the site or emails will be available for a suspended account.
6. Cancellations & Refunds:-
6.1 AI Hosts reserves the right to suspend OR terminate services on receipt of Abuse complaints and no refund would become due.
6.2 Only first-time accounts are eligible for a refund. For instance, if you’ve had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
6.3 Full refund available within 30 days for first account holders. Refund requests after 30 days will be refunded on a prorated basis of any unused time..
6.4 Any service interruptions or downtime due to scheduled maintenance by AI Hosts or our network providers will not count towards the uptime guarantee. AI Hosts is not liable in any way for failure of third party services.
7. Data-backups and Disclaimer
7.1 While all possible attempts would be made to retain a working backup copy of data; AI Hosts does not assume any responsibility of backing up files & data residing in your hosting account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on AI Hosts servers. Any backup which may be provided to the customer will not include media files.
7.2 AI Hosts takes no responsibility for any damages or losses a client or their business may suffer from using the service. This includes but is not limited to data loss and the client assumes full responsibility for their own data.
8. Service Level Agreement and Associated Credits
8.1 In the event of AI Hosts not being able to offer 100% network uptime for the particular calendar month, a performance credit will be given to the customer’s account. Such downtime would be measured from the time customer contacts us until the service is resumed. A credit of 50p would be given for each 30 minute period of downtime. At no point of time shall the total credit exceed the amount paid as one month’s hosting fee.
8.2 Downtime caused or occurring as a result of the following actions / activities shall not be considered under this Service Level Agreement.
(i) Issues / Factors / Causes outside the immediate purview of AI Hosts
(ii) Pre-Announced scheduled maintenance downtime
(iii) Customer’s Local Area Network (LAN)
(iv) Softwares / Access Limitations / within the customer’s local and internal network environment which includes but is not limited to local area workstations, firewall - both hardware and software, anti-virus / spyware programs, bandwidth shaping and configuration devices or any other such software / tool / virtual device.
(v) Any end-user software or the customer’s internet connection
(b) AI Hosts shall not be held liable to give credit or offer compensation for any failure / delay / interruptions which occur as a result of the customer, the customer’s employees / agents / contractors (sub-contractors). The instances for such occurrences include but are not limited to;
(i) Operating system / Software / Applications associated issues.
(ii) Any resource abuse / server overload / over utilization of resources on the server
(iii) Improper / inaccurate / erroneous configuration of any software
(iv) Wrong / non-compliant usage of installed softwares
(v) Issues / complications / problems arising out of operating system exploits, corruption of the OS or its binaries, service exploits, hacking or bandwidth-based attack of any nature and intensity.
(c) Downtime due to suspension of an account is excluded from the service level agreement.
9. Data Protection and Privacy
9.1. At the time of signing-up, we ask you to provide us with your exact postal address, telephone number and email address. We use this information to contact you after the sign-up & confirm the web hosting order received on your account.
9.2. Your email address is used to remain in contact with you at all times. All our invoices, support ticket replies & other communications are all done through emails. This email address is to be used when requesting for any service which requires the user to be authenticated. We also send you emails informing about the upgradation in services, networks & other information which we deem to be necessary to be sent to our clients. Please let us know if your email address changes.
9.3. We do not share your personal information with any third party. This excludes official government and policing bodies to whom we may be obliged to share such information.
AI Hosts reserves the right to change these terms at any time without prior notice.
